Object and scope of application
The present General Terms and Conditions of Sale exclusively regulate purchases and sales made through META®'s online store, between the “Professional Consumer Clients”, henceforth known as “Client”, as the buyer and PIRANHA GLOBAL as the seller, and apply to all visitors of the website www.forgedbymeta.com, as well as any transaction of a commercial nature performed through this online virtual store.
Browsing the site, as well as the purchase of any product at www.forgedbymeta.com, provides implicit agreement to the present general conditions of use and hire.
PIRANHA GLOBAL sells all products of the brand META® and other brands represented by PIRANHA GLOBAL, and will be the entity responsible for the sale at the site www.forgedbymeta.com of the merchandise of the aforementioned brands, while all “e-commerce” services are available solely to Professional consumers.
It is considered to be a “Professional Consumer Client” or a “User” or even a “Client” any who acts/purchases with the intent of professional use, for utilization in their business or profession.
PIRANHA GLOBAL reserves the right to alter these conditions of use and hire, without prior notice, as well as to modify at any moment the information and commercial offer presented on any products, prices, promotions, commercial conditions and services, with the assurance that any alteration will always be displayed at the site www.forgedbymeta.com.
META® (PIRANHA GLOBAL, LDA.) reserves the right to not process any order received from users who are not “Professional Consumers” nor any package who is not compliant with the general terms of sale of the “Seller” (META®).
The client should provide META® (PIRANHA GLOBAL, LDA.), as the seller, an e-mail or postal address, or other contact information, which is correct and complete and accepts that META® may contact the client using this information, should it be found necessary.
Information concerning the contents of the META® online store
Reproducing, transferring, distributing or storing content from the META® online store, without prior written authorization, is forbidden for any purpose other than strictly adequate use.
It is strictly forbidden to create links to our website for commercial purposes or without previous authorization from META® (“PIRANHA GLOBAL”). In the same manner using the domain www.forgedbymeta.com for inappropriate purposes, is liable to legal recourse through proper legal channels from META® (“PIRANHA GLOBAL”).
In the event that you find, in other sites, links that allow you access to www.forgedbymeta.com or references to the META® online store we inform you that “PIRANHA GLOBAL” has no responsibility over those mentioned links or webpages, nor the content displayed on them.
We are deeply committed to making sure the information presented at www.forgedbymeta.com is free of typographical errors and whenever these occur we will correct them as soon as possible.
All contractual information is written in Portuguese, as well as information on the merchandise, e-mail communication and sale formalization, with the exception of expressions that are particular to the scope of the business.
In the event that the information presented does not match the characteristics of the product, the Client has the right to rescind the contract of purchase and sale within the applicable legal rules.
The photographs displayed on the website are merely illustrative, thus we recommend that you carefully consult the product's details to be better informed regarding the characteristics of the merchandise that you intend to acquire.
The prices and specifications of products are subject to alteration without prior notice. Although META® (“PIRANHA GLOBAL”) is extremely careful in order to keep all information up to date, some products may be assigned an incorrect price, which is why we verify the prices whenever we process an order. If the correct price is higher we will inform the “Professional Consumer Client” by e-mail and await his decision to either accept the new price or cancel his order.
The product catalogue available at the META® online store is independent of other online stores, whether it concerns price, the displayed products, or the amount in stock. All promotional campaigns have limited stock and are exclusive to META® online store.
Validation of the request to buy or order assumes the Client has knowledge of, and agrees to, the General Terms and Conditions of Sale of the site www.forgedbymeta.com.
All data recorded by META® (“PIRANHA GLOBAL”) constitutes proof of the set of transactions made between the Seller and the Client, and it is the responsibility of META® (“PIRANHA GLOBAL”) to archive the electronic document in which the contract is formalized.
Obligations of Clients and Users
Any visitor of the website www.forgedbymeta.com is obligated to fulfil and respect the present general conditions, namely by abiding the following duties:
— It is forbidden to introduce, store or spread through the META® website any content that is slanderous, obscene, injurious, xenophobic and/or of any other nature that violates the general principles of law and public order
— Guarding, and not divulging, your site login password to keep third parties from accessing your account and personal data
— Not using fake identities
— Granting your personal data and address correctly so that “PIRANHA GLOBAL” (META®) can properly process your orders
The Client is solely responsible for the veracity of the personal data provided to META® (“PIRANHA GLOBAL”) and commits to fill out and immediately inform of any alteration through his Registry Account at www.forgedbymeta.com.
META® (“PIRANHA GLOBAL”) is not responsible for any delays or impossibility to process an order as a result of errors or insufficient information in the data provided by the Client.
Placing an order online
To place an order at www.forgedbymeta.com it is necessary for the “User” to have a valid e-mail account of frequent use and to register as a META® Client by carefully filling out the form available online with his personal information (special care should be taken when filling out the address).
Placing an order at www.forgedbymeta.com is very easy: Browse the pages of the META® online store and find the products that you wish to purchase; add the selected products to the Shopping Cart by pressing the “Buy” button; then, select the payment method; confirm your order all the way to the end; finally, you will receive confirmation of you order by e-mail; upon finalizing the process of purchase, your order is confirmed and you must simply await the predicted amount of days for the postal shipment of the merchandise.
As soon as your purchase is completed, you should receive an automatic e-mail confirming the transaction barring any technical problems. We suggest that you print it or download a copy of it for future reference. Should the information be incorrect you may immediately request its alteration, or even the cancelation of the purchase made.
In the event that the payment is not confirmed or of any non-compliance with the present General Terms and Conditions of Sale, META® (“PIRANHA GLOBAL”) reserves the right to decline your order, or to cancel it partially or completely, even after its automatic confirmation.
Product availability and order confirmation/cancellation
META® (“PIRANHA GLOBAL”) will only process an order made by a client once it has been confirmed. Depending on the selection made, that confirmation may depend on the confirmation of payment. As such, META® (“PIRANHA GLOBAL”) cannot guarantee the merchandise's availability until the aforementioned processing begins.
Aside from the normal exceptions (stock out, breach of the terms of sale from the client, or any anomaly beyond META®'s control), the orders are delivered within 24 hours (in business days), as long as they are placed until 6 pm of the previous day. Naturally, the estimated time until delivery can change depending on the shipping company you choose and the order's destination.
META® (“PIRANHA GLOBAL”) only dispatches orders on business days. Thus, the estimated time until the delivery of the orders does not account for weekends nor holidays. Delays that occur in the shipping of the merchandise, relative to the estimated dates, do not grant the right to indemnity.
Fulfilment of all orders placed at the website is subject to product availability. META® tries to ensure that all items for sale at the website are in stock. However, META® (“PIRANHA GLOBAL”) reserves the right to not accept any orders or cancel already confirmed orders for any products that are no longer in stock. In the event of product unavailability and/or stock out, “PIRANHA GLOBAL” (META®) will immediately inform the Client of the partial or total cancellation of his(her) order.
Order confirmation or cancellation
META® (“PIRANHA GLOBAL”) may not validate an order if there are insufficient guarantees that payment can be collected, if the order is incomplete or incorrect, or when the products ordered are no longer available. In any of the aforementioned cases, META® will inform the client by e-mail that the contract of sale was voided and that META® (“PIRANHA GLOBAL”) did not go through with the sale, specifying the reasons for such.
If the products ordered at www.forgedbymeta.com are no longer available at the moment you last accessed the site, in spite of having received confirmation of your order, or when META® (“PIRANHA GLOBAL”) receives your request, the “Seller” will immediately inform the “Client” of the products' unavailability, never exceeding the deadline of 30 days after the request has been received.
If an order has been made, and its respective payment confirmed, for products that have become unavailable in the meantime, META® (“PIRANHA GLOBAL”) will reimburse for the money spent on the unavailable items. If the sum corresponding to the payment has not yet arrived at PIRANHA GLOBAL's bank account, the reimbursement will occur at a later time.
META® (“PIRANHA GLOBAL”) reserves the right to refuse any order, regardless of the reason and is not responsible for any damages or costs, and also reserves the right to cancel any purchase even if it has already been accepted or confirmed by META® (“PIRANHA GLOBAL”), namely in the following situations: the information contained in the invoice is not correct or verifiable; the order is flagged by the website's Security Systems as incorrect, irregular, or as being susceptible to fraud; when payment for the order has not been transferred within 5 business days after the order has been accepted (in case this was the selected payment method); when it is not possible to deliver the order at the address given by the “User”; if it is determined that the “Buyer” did not have the capacity to perform that act; if it is found, upon verification, that an error was made in the display of the product(s)'s price(s); if the order was presumed to have been placed by a reseller.
Payment Terms and Safety Guarantees
All available forms of payment will be presented at www.forgedbymeta.com. No other form of payment will be accepted.
You may pay for your products using credit or debit cards, through Paypal's payment system, or you can also pay for you order using MULTIBANCO, should you choose this last option the META® website will provide you with instructions on how to use this form of payment.
In payments made by credit or debit card, all details (such as card number, expiration date or security code) will be sent by encrypted protocol to the company that provides the remote electronic payment services, Paypal, without allowing any third parties access to the information being transmitted.
This information will not be utilized by META® (“PIRANHA GLOBAL”), except to perform the necessary operations for the purchase or reimbursement, in the event of a product return in conformity with the exertion of the right to return, or to report fraud cases to the police.
Should the Client opt to pay by MULTIBANCO, we will only begin processing the order upon receiving payment. Which is why, when using this form of payment, we advise you to make your way to the Automated Teller Machine (ATM) as soon as possible because if 5 days have passed after the order has been placed, and we have not received any payment, the order will be cancelled.
The price of the purchased products and the transportation costs, as indicated in the order's form, will be charged to your account once the purchased products are effectively shipped.
We urge you to not attempt to pay by any method other than the one specified at www.forgedbymeta.com. If you do META® (“PIRANHA GLOBAL”) cannot be held accountable for the loss of the payment, nor for any other damages that might result from it.
Security of the META® online store and of all transactions
The META® online store uses the latest and most robust security technologies available in encryption platforms. All payment information that you provide will be encrypted, from the moment you initiate your transaction, to the moment in which the order is processed, and will not be saved on any public server.
Although we use a very robust encryption software, any payment transmitted through the internet, or by e-mail, runs some risks particularly when the “User” doesn’t take the necessary precautions and doesn’t adopt the proper responsible conduct.
IMETA® (“PIRANHA GLOBAL”) cannot be held accountable for any damages suffered as a result of the use of electronic means of communication, namely the damages incurred from faults or delays in delivering electronic communications, from interception or manipulation of electronic communications by third parties or from computer programs used for communication or virus transmissions.
Title Retention of the commercialized products
META® (“PIRANHA GLOBAL”) retains ownership of the company's products until it has received full payment for all of the products.
The prices of the products displayed on the website www.forgedbymeta.com do not include/account for Value Added Tax (VAT).
The total price specified in the Professional Clients checkout menu includes taxes and shipping costs. The prices are calculated before the order's confirmation, which you can print or download for future use. Please transfer only the exact amount specified on the order's confirmation and make a single transfer per order.
Shipping fees are calculated per order, thus the exact cost of the shipping fee will depend on which country your order is delivered.
All prices are displayed in Euros and any change to the country where the order is delivered may influence the prices, due to transportation costs.
Quality and Warranty
META® (“PIRANHA GLOBAL”) shall only commercialize items of very high quality at www.forgedbymeta.com and will never sell second-hand products, defective products, or any product of quality inferior to the market's existent standards, should that happen we will action the warranty given by the represented brands, being theirs the responsibility to cover the inherent costs.
The products available for sale at www.forgedbymeta.com might not be an exact match to the actual article in terms of the image displayed and colours, especially due to the internet browser and monitor used.
Product Exchange and Return
Should you decide to return the purchased products, META® (“PIRANHA GLOBAL”) reserves the right to not accept the products' return if the parts returned have been violated in any way.
After receiving the order, the “Buyer” has a 30 day deadline to return or exchange the product(s) should (s)he determine that they are defective.
META® will only trade merchandise for products from the same brand as the product being traded in, which is to say an item of the META brand can only be returned for an item of the same Brand.
For all returns and trades, the shipping costs will be covered by the client (except for quality motives).
Trading or returning the “Buyer”'s order shall be performed by placing the items you wish to return in their original package, and with no signs of usage, along with order's invoice.
Upon receiving all of the ordered products, or just part of them, at our facilities, we will proceed with the treatment within the average period of a week. If the return is confirmed, you will receive a refund through the same payment method. Refunds are only made to the account/card that originated the purchase. In the event of a simple exchange of item, colour or size, then, after the product's availability is verified, the product will be sent to the address you specify in the exchange process.
Before shipping, the “Buyer” can cancel the product's order. If the “Buyer” places an order and wishes to cancel it, at an early stage, he must check the order's status.
If the cancellation request is successful, the client will be notified of this decision by e-mail and the revocation will be processed with no costs to the client.
If the cancellation request cannot be met because the order has already been shipped, the products will be sent to the “Buyer” who, should he maintain his intent to cancel his order, must refuse to receive the merchandise and trigger the return mechanisms at the META® online store.
Once the return has been confirmed and the order has been received at the META® (“PIRANHA GLOBAL”), the reimbursement will be processed.
The amount of the reimbursement will take into account the moment when the order was cancelled, knowing that if the package was sent and received by the Client, the shipping fees will be deducted from the refund.
Conditions applicable to the Promotional Codes (discounts)
When utilized according to the established rules, a promotional code entitles the user to take advantage of a promotion/discount related to the purchase of a specific product or a set of products, during the period assigned/associated to the promotional code/campaign.
Promotional codes are personal and non-transferable and can only be used for online purchases made at the site. It is not permitted to sell, trade or donate a promotional code. The client in possession of the code cannot upload or provide a promotional code at any website or any other form of public offer, donation, sale or trade. The use of promotional codes for commercial purposes is not permitted.
Promotional codes are limited to a single use per product and per order (unless otherwise indicated). Promotional codes cannot be combined with any other promotions or special offers.
Promotional codes cannot be exchanged for money and will not be re-edited or restituted.
Without prejudice to any other rights, META® (“PIRANHA GLOBAL”) reserves the right to immediately invalidate a promotional code if there is any suspicion that it is being used in violation of the aforementioned assumptions.
Validity of promotions or commercial campaigns
Promotional offers or commercial campaigns announced at www.forgedbymeta.com are only valid for as long as they are being displayed on the site and according to the established conditions, unless otherwise communicated on the site.
In the event of return or exchange of items purchased within the purview of commercial Campaigns or Promotions, you will be refunded or given only the amount that you effectively spent to purchase the item that you intend to return or exchange.
META® (“PIRANHA GLOBAL”) will only be liable for damages suffered by the “Buyer” in the event that such damages result from violations attributable to META® (“PIRANHA GLOBAL”)'s contractual obligations before the Client, or in the event that liability results from the applicable legal right.
If the “Buyer” has suffered damages related to website activity, META® (“PIRANHA GLOBAL”)'s liability is limited to: damages in META®'s products, reasonable and verifiable costs incurred by the “Buyer” because of violation of the present General Terms and Conditions of Sale from META® (“PIRANHA GLOBAL”).
META® (“PIRANHA GLOBAL”) cannot be held responsible for damages suffered by a third party as a result of the use of any of our products. META® (“PIRANHA GLOBAL”) cannot be held responsible for damages suffered by the “Buyer” as a result of improper use of our products.
META® (“PIRANHA GLOBAL”) is not responsible for damages resulted from incorrect information on the website.
All products commercialized by META® (“PIRANHA GLOBAL”) are in conformity with Portuguese and community legislations.
META® (“PIRANHA GLOBAL”) declines any responsibility in the event of violation of the legislation of the country where the order is delivered. It is the Client's responsibility to check with the local authorities to know the conditions to import or use the products (s)he intends to order.
Intellectual and Industrial Property
All jobs, illustrations, works and images displayed or represented at www.forgedbymeta.com are strictly reserved in terms of copyright and intellectual property rights, worldwide.
In conformity with and according to the terms of the Intellectual Property Code, the use of information is only authorized for professional purposes, barring any contrary legal provisions including more restrictive provisions from the aforementioned code.
Any reproduction or representation, both total and partial, of the site www.forgedbymeta.com, as a whole or partially, of the elements included in it is strictly forbidden.
The social denominations, brands and distinctive signs displayed at www.forgedbymeta.com are protected in terms of the legal provisions applicable to industrial property. Display or representation of the whole or part of any distinctive signs is strictly forbidden and must be subject to previous written authorization from the holder of the META® brand.
Should the “User” wish to use information or content from the site (s)he must first obtain written permission, granted by META® (“PIRANHA GLOBAL”).
The present General Terms and Conditions of Sale and all emergent litigation related to these general terms, including its validity, the use of the site www.forgedbymeta.com or any purchase made on it must be drafted by Portuguese Law.
In case of litigation regarding the interpretation or execution of the present General Terms and Conditions of Sale, META® (“PIRANHA GLOBAL”) and the “Buyer” shall endeavour to reach an amicable settlement, that is fair and adequate, within at most 60 (sixty) days, counted from the reception of the communication addressed to this effect by any of the involved parties.
In the absence of an amicable settlement, according to the terms outlined in the previous number, and in the event of breach of the present General Terms and Conditions of Sale, both PARTIES agree to accept Viseu's Civil Court as the competent court, and explicitly renounce all others.
Personal Data Protection
Changes to the Terms & Service of META®'s online store
META® (“PIRANHA GLOBAL”) has the right to change the present General Terms and Conditions of Sale at any time. The “Buyer” is subject to the principles and terms in effect at the time of his/her order, unless the law or the proper authorities impose any changes to them.
